Conditions of sale
These conditions apply to every purchase made on yourbrand.com. Please read them before placing an order; by doing so you accept them. Nothing here limits the rights the law gives you as a consumer.
CONTENTS
1. Customers
These conditions govern the sale of products offered on yourbrand.com by Fe Lusion GmbH, Wollzeile 12, 1010 Vienna, Austria.
The Website is intended for consumers, meaning natural persons acting for purposes outside their trade or profession, who are at least eighteen years of age and have the legal capacity to enter into a contract. Orders placed for resale are not accepted.
2. Acceptance of an Order – Contract of sale
An order placed on the Website constitutes an offer to purchase. The order confirmation sent by e-mail acknowledges receipt of that offer and does not conclude the contract.
The contract of sale is concluded when we send the shipping confirmation for the pieces despatched. Where a piece cannot be supplied, we will tell you promptly and no charge will be made for it.
We reserve the right not to accept an order where the piece is unavailable, where the price shown was manifestly incorrect, or where payment cannot be authorised.
3. Payments
Payment may be made by the methods shown at checkout. The amount is charged when the order is despatched, except where the chosen payment method requires authorisation at the time the order is placed.
Card details are handled entirely by our payment provider over an encrypted connection; the full card number is never seen or stored by us.
An invoice is issued electronically and sent with the shipping confirmation.
4. Shipping and deliveries
Orders are despatched from Austria on working days, generally within two working days of the contract being concluded.
Shipping is complimentary on all orders. Delivery times shown at checkout are estimates and are not guaranteed; where a delay exceeds thirty days from the order date you may cancel the order and receive a full refund.
Risk passes to you on delivery. Please examine the parcel on arrival and tell us within fourteen days if anything appears damaged in transit.
5. Collection from the boutique
Where offered, an order may be collected from our boutique at Wollzeile 12, Vienna. We will write to you when the order is ready.
Collection must be made within fourteen days by the person named on the order, on presentation of the order confirmation and a valid identity document. Orders not collected within that period are returned to stock and refunded in full.
6. Prices
Prices are shown in the currency selected for your country and include applicable value-added tax. Duties and import charges, where they apply outside the European Union, are shown at checkout or payable on delivery.
Prices may change at any time, but a change never affects an order already confirmed. Where a price is manifestly incorrect we will contact you before despatch and you may confirm or cancel the order.
7. Vouchers and discount codes
A voucher or discount code may be used once, by the person to whom it was issued, before its expiry date, and may not be combined with another offer unless expressly stated.
Vouchers hold no cash value, cannot be exchanged for money, and are not reissued if lost. Where an order paid partly by voucher is returned, the voucher portion is refunded as a new voucher.
8. Defective and non-conforming pieces – Guarantee
We are under a legal duty to supply pieces that conform to the contract. Where a piece is faulty or not as described, you have the statutory remedies available under Austrian and European consumer law, including repair, replacement, a price reduction or cancellation.
The legal guarantee runs for two years from delivery. Write to clientcare@yourbrand.com with the order number and a photograph, and we will arrange collection at our cost.
Separately from that guarantee, we mend any piece we have made, for as long as we are here, at no charge. Wear that follows from ordinary use is mending, not a defect.
9. Exchange and return of pieces
You may withdraw from the contract within thirty days of delivery, without giving a reason. This is longer than the fourteen days required by law.
Pieces must be returned unworn, unwashed and complete, with their labels attached and in their original packaging. Made-to-measure pieces and altered garments cannot be returned unless faulty.
Request a return from your order confirmation or by writing to clientcare@yourbrand.com. Return shipping is complimentary. A refund is issued to the original payment method within fourteen days of the pieces reaching the atelier.
An exchange for another size or colour is treated as a return followed by a fresh order, and is arranged for you at no charge.
10. Applicable law and disputes
These conditions are governed by Austrian law, without prejudice to the mandatory protections available to a consumer under the law of their country of residence.
The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are, however, always glad to settle a matter directly first.
11. Communications and complaints
All communications relating to an order should be addressed to clientcare@yourbrand.com, or by post to Fe Lusion GmbH, Wollzeile 12, 1010 Vienna, Austria.
A complaint is acknowledged within two working days and answered within fourteen days.
12. Miscellaneous
If any provision of these conditions is held to be invalid, the remainder continues in force.
Our failure to enforce a provision on one occasion is not a waiver of it. These conditions, together with the Privacy Policy and the Cookie Policy, constitute the whole agreement between us in respect of a sale.
We may amend these conditions; the version in force is the one published on this page at the moment an order is placed.
